1. Acceptance of Terms
By adding CinemaCircle to your Discord server, using any of its commands, or accessing the CinemaCircle web dashboard, you agree to be bound by these Terms of Service ("Terms"). If you are adding the bot on behalf of a Discord server, you represent that you have the authority to do so and that all server members who interact with the bot are also bound by these Terms.
If you do not agree to these Terms, please do not use CinemaCircle.
These Terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
2. Description of Service
CinemaCircle is a Discord bot and associated web dashboard ("the Service") that provides film logging, ratings, watchlists, movie night coordination, and related features to Discord server communities. Features available depend on the subscription plan associated with your server.
The Service integrates with third-party APIs including Discord, TMDB (The Movie Database), and YouTube. We are not affiliated with these services.
3. Eligibility
You must be at least 13 years old to use CinemaCircle, consistent with Discord's own Terms of Service. By using the Service, you confirm that you meet this requirement. If you are under 18, you confirm that you have parental or guardian consent to use the Service.
4. Your Account & Server
4.1 Server Administration
The person who installs CinemaCircle is responsible for how it is used within that Discord server. Server administrators are responsible for ensuring their members use the Service in compliance with these Terms and with Discord's Community Guidelines.
4.2 Accurate Information
You agree to provide accurate information when configuring the bot (including optional /setup) and when managing billing through the dashboard.
4.3 Account Security
You are responsible for maintaining the security of your Discord account. CinemaCircle dashboard sessions use Discord OAuth2 — we never store your Discord password. If you believe your account has been compromised, contact Discord support immediately.
5. Acceptable Use
You agree not to use CinemaCircle to:
- Harass, threaten, or abuse other Discord users
- Post or log content that is illegal, defamatory, obscene, or infringes third-party rights
- Attempt to reverse engineer, exploit, or find vulnerabilities in the Service without our permission
- Use automated means (bots, scripts) to interact with CinemaCircle commands beyond its intended use
- Circumvent rate limits, plan quotas, or feature gates
- Use the Service in any way that violates Discord's Terms of Service or Community Guidelines
- Impersonate CinemaCircle, our team, or other users
- Use the Service for any commercial purpose other than its intended use as a community tool
We reserve the right to suspend or terminate access for any server or user found to be in violation of these Terms, at our sole discretion.
6. Content
6.1 Your Content
You retain ownership of the content you submit through CinemaCircle (film reviews, ratings, watchlist entries, etc.). By submitting content, you grant CinemaCircle a limited, non-exclusive licence to store, display, and process that content solely for the purpose of providing the Service to your server.
6.2 Content Standards
Content you submit must not be illegal, harmful, threatening, abusive, defamatory, obscene, or otherwise objectionable. We reserve the right to remove content that violates these standards, though we are not obligated to monitor all content.
6.3 Third-Party Content
Film metadata, posters, trailers, and related content are sourced from TMDB and YouTube. This content remains the property of its respective owners. CinemaCircle does not claim ownership of third-party media data.
7. Subscriptions & Billing
7.1 Plans
CinemaCircle offers a free tier and paid subscription plans (Pro and Ultimate), billed monthly or annually. Subscriptions are per Discord server (guild). Current pricing is displayed at cinemacircle.app/#pricing. We reserve the right to change prices with 30 days' notice.
7.2 Billing & Payment
Paid subscriptions are processed through Whop. By subscribing, you also agree to Whop's Terms of Service. All prices are in GBP and include applicable VAT where required.
7.3 Cancellation
You may cancel your subscription at any time through the CinemaCircle dashboard or via Whop. Cancellation takes effect at the end of the current billing period. We do not offer refunds for partial periods unless required by applicable law.
7.4 Downgrade on Non-Payment
If payment fails or your subscription lapses, your server will be automatically downgraded to the Free plan. Your data will be retained for 30 days before any paid-plan-specific data may be removed. Resubscribing within this window restores full access.
7.5 Consumer Rights
If you are a consumer in the UK or EU, you may have a 14-day right to cancel a new subscription and receive a refund, provided you have not actively used the paid features. To exercise this right, contact us at [email protected] within 14 days of subscribing.
8. Availability & Service Levels
We aim to keep CinemaCircle available and functional at all times, but we do not guarantee uninterrupted availability. The Service is provided "as is" without warranty of any kind. We may perform maintenance, updates, or modifications that temporarily affect availability — we will endeavour to communicate planned downtime in advance.
We reserve the right to modify, suspend, or discontinue any part of the Service at any time. If we discontinue the Service entirely, we will provide reasonable notice and offer pro-rated refunds for remaining paid subscription periods.
9. Intellectual Property
CinemaCircle, its logo, branding, software, and original content are the property of CinemaCircle and protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from our materials without written permission.
TMDB data is used under the TMDB API terms. YouTube data is used under YouTube's Terms of Service. Discord is a trademark of Discord Inc.
10. Limitation of Liability
To the maximum extent permitted by applicable law, CinemaCircle and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to loss of data, loss of profits, or loss of goodwill.
Our total liability to you for any claim arising from these Terms or use of the Service shall not exceed the amount you paid to us in the 12 months preceding the claim.
Nothing in these Terms limits our liability for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation, or any other liability that cannot be limited by law.
11. Indemnification
You agree to indemnify and hold harmless CinemaCircle and its operators from any claims, losses, damages, and expenses (including reasonable legal fees) arising from your violation of these Terms, your use of the Service, or your violation of any third party's rights.
12. Data & Privacy
Your use of CinemaCircle is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to data practices described in the Privacy Policy.
13. Termination
We may terminate or suspend your access to the Service at any time, with or without notice, for conduct that we determine in our sole discretion violates these Terms or is harmful to other users, us, or third parties.
You may terminate your use of the Service at any time by removing the bot from your Discord server and cancelling any active subscription.
Upon termination, your right to use the Service ceases immediately. Provisions of these Terms that by their nature should survive termination (including intellectual property, indemnification, and limitation of liability) shall survive.
14. Changes to These Terms
We may update these Terms from time to time. We will notify server owners of material changes via a bot announcement or by posting a notice on this page with an updated date. Your continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.
15. Governing Law & Disputes
These Terms are governed by the laws of England and Wales. Any dispute arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales, except where you have mandatory consumer rights in another jurisdiction that override this.
